This Software & Content License governs the use of software, virtual instruments, audio plug-ins, Kontakt libraries, sample libraries, presets, recordings and other digital products supplied by EVA Instruments.
By downloading, installing or using an EVA Instruments product, you agree to this License.

2. What you receive
When you obtain an EVA Instruments product, you receive a licence to use that product under these terms.
You do not acquire ownership of the underlying software, source code, plug-in binaries, samples, recordings, presets, scripts, graphics, documentation or other intellectual property contained in the product.
Unless a product is supplied under separate written terms, this License applies to both paid and free EVA Instruments products.
3. Licence grant
Subject to this License, EVA Instruments grants the licensed customer a worldwide, non-exclusive licence to install and use the product for personal and commercial creative work.
The licence is not limited to a fixed number of computers owned or controlled by the licensed customer. The product may be used on both supported Mac and Windows systems where compatible.
The licence is associated with the customer or organisation that obtained the product and with the relevant purchase/account record. It is not a public, shared or general-access licence.
A licence may be used:
- by an individual customer on that customer's own systems;
- by a studio, company or other organisation that purchased the product, including members of its team using the product for work carried out for that organisation;
- on multiple systems used as part of the licensed customer's normal creative or production workflow.
This does not permit a product to be made generally available to unrelated third parties, the public, students in a shared teaching environment, or separate businesses that did not obtain the licence.
4. Permitted commercial use
You may use EVA Instruments products in commercial and non-commercial creative work, including music production and released music, film and television, online video, advertising, videogames and interactive media, podcasts and broadcast, theatre and live performance, client work, sound design for a specific production, stems, mixes, masters and other rendered deliverables supplied to a client.
You may charge for, sell, license, publish, broadcast or otherwise commercially exploit a finished production created using EVA Instruments products without paying additional royalties to EVA Instruments.
For the purposes of this License, a finished production means a creative work or project in which the EVA product is used as a production tool or as part of a broader creative result, rather than being redistributed as a substitute for the EVA product itself.
5. Client projects and stems
You may use EVA Instruments products when working for clients.
You may deliver rendered audio, including isolated stems, where those files are part of a specific client project or production.
You may not provide the client with EVA product files, installers, plug-in binaries, Kontakt libraries, source samples, presets or other protected product assets merely so that the client's system can open or reproduce the product without the client having an appropriate licence of its own.
A rendered stem is permitted when it is a deliverable from a real production. A collection of rendered notes, one-shots, loops or isolated sounds intended to function as a reusable replacement for an EVA library is not.
6. Sample-based products and source content
If an EVA Instruments product contains samples, recordings, loops, impulse responses, presets, MIDI, scripts or similar proprietary content (“Source Content”), you may use that Source Content through the product to create finished productions.
You may not:
- extract, distribute, resell, sublicense, upload or share Source Content in its original form;
- distribute Source Content after processing where the result remains substantially identifiable as a reusable source asset;
- create a sample pack, loop pack, sound library, preset library, Kontakt library, virtual instrument or similar reusable content product from EVA Source Content;
- render the notes or sounds of an EVA sample-based instrument systematically in order to recreate, clone or substitute for the original library;
- make Source Content available in a form that allows another person to use it as production source material independently of the licensed EVA product.
These restrictions apply whether the resulting collection is sold, licensed, uploaded for free or otherwise distributed.
Nothing in this License prevents anyone from independently creating a competing or similar product using their own independently created recordings, code, design and other materials. The restriction concerns copying, extracting or reusing EVA Instruments intellectual property, not independent competition or independent development.
7. Use of audio effects on your own source material
The restrictions above do not prevent you from using an EVA audio effect plug-in to process audio that you own or are otherwise authorised to use.
For example, you may use an EVA effect to process your own recordings while producing music, sound-design assets or other commercial material, provided that doing so does not distribute EVA proprietary code, internal assets or protected Source Content.
8. Prohibited distribution and sharing
Except where mandatory law provides otherwise, you may not:
- resell, rent, sublicense or commercially distribute the product itself;
- share installers, libraries, plug-in binaries, serials, account access or protected product files with unrelated third parties;
- upload the product or its protected files to file-sharing, cloud-sharing, marketplace or public-download services for use by others;
- remove or circumvent copyright, licence, security or ownership notices;
- use one licence as a public-access, classroom, computer-lab or multi-user educational licence without approval from EVA Instruments.
Making a backup for your own legitimate use is permitted.
9. Studios and organisations
A studio, company or other organisation may purchase one EVA Instruments licence for use within that organisation's own production workflow.
The licence may be used by personnel working for that organisation where the product remains under the organisation's control and is used for the organisation's projects.
This does not authorise redistribution of the product to unrelated businesses or individuals.
Educational institutions, schools, universities, training centres and similar environments in which many different students or members of the public may use shared systems should contact support@evainstruments.com.
EVA Instruments may provide special educational terms, discounts or, at its discretion, complimentary licences to qualifying educational institutions.
10. Backups and re-downloads
You may create and keep reasonable backup copies of product files for your own licensed use.
EVA Instruments currently provides re-download access to purchased products without a preset download-count or time limit through the services where those products remain available.
Customers are encouraged to maintain their own backups.
The right to use a validly licensed product does not expire merely because the original download is no longer available through a particular technical delivery method.
11. Updates and successor products
Updates released for the same EVA Instruments product are provided to licensed users without an additional update fee.
A separately released successor or new product generation may be sold as a separate product and is not automatically included in the licence for an earlier product.
12. Licence transfers
A licence is not intended to be freely shared or transferred between users.
If you want to transfer a purchase or licence to another person or organisation, contact support@evainstruments.com.
EVA Instruments may approve and process a transfer where appropriate. If a transfer is approved, the previous licensee must stop using the transferred product and remove copies that it is no longer entitled to use.
Nothing in this section limits any transfer or resale right that cannot lawfully be restricted under mandatory applicable law.
13. Reverse engineering, modification and interoperability
You may not reverse engineer, decompile, disassemble, decode or otherwise attempt to derive protected source code or internal implementation details from EVA Instruments software, except to the extent that a specific act is expressly permitted by mandatory applicable law and may not lawfully be restricted by contract.
Nothing in this License is intended to prevent making a backup copy where applicable law gives a lawful user that right, observing, studying or testing the functioning of software where applicable law gives a lawful user that right, or performing acts strictly necessary to achieve interoperability of an independently created program where, and only to the extent, such acts are protected by mandatory law.
Information obtained under a mandatory interoperability exception may not be used to infringe EVA Instruments intellectual property or to create or market a substantially similar copy of protected expression where the law does not permit such use.
14. Artificial intelligence and machine learning
Unless EVA Instruments gives prior written permission, you may not use or provide EVA product files, Source Content, isolated samples, presets, protected recordings, source code or other proprietary product assets as a training dataset for artificial-intelligence or machine-learning systems, for model training, fine-tuning or dataset construction, or for building a model or system intended to reproduce or generate EVA proprietary source assets.
This restriction does not prevent you from using your own finished music or other finished productions in your own AI or machine-learning workflows merely because an EVA product was used during production, provided that EVA proprietary product assets are not supplied or exposed separately in reusable form.

15. Third-party software and formats
Some products may require compatible third-party software, a supported DAW, plug-in host or a full version of Native Instruments Kontakt.
Where a product page states that the full version of Kontakt is required, that third-party software must be obtained separately.
References to third-party products or trademarks identify compatibility or requirements only and do not imply ownership, sponsorship or affiliation unless expressly stated.
16. Free, promotional, educational, review and NFR licences
Free products remain protected by EVA Instruments intellectual-property rights and are subject to this License unless separate terms are supplied.
Promotional, educational, review, evaluation or not-for-resale (“NFR”) licences may be subject to additional written conditions supplied with the licence. Those additional conditions apply alongside this License and prevail where they specifically conflict with it.
17. Intellectual property
All rights not expressly granted by this License are reserved by EVA Instruments and, where applicable, its licensors.
This includes rights in software, code, recordings, samples, sound content, presets, scripts, graphics, documentation, product names and other protectable materials.
This License does not grant any right to use EVA Instruments trademarks, logos or branding except as reasonably necessary to identify the product in ordinary factual references.
18. Term and termination
This License continues for as long as the licensed customer lawfully retains the right to use the product.
EVA Instruments may terminate the contractual licence rights of a customer who materially breaches this License, subject to applicable mandatory law.
Where a breach can reasonably be remedied, EVA Instruments may request that the breach be stopped or corrected.
Termination does not affect rights in finished productions lawfully created and distributed before termination, provided those finished productions do not themselves contain unlawfully redistributed EVA product files or Source Content.
19. Statutory rights and warranties
Nothing in this License excludes or limits any statutory consumer right or software-user right that cannot lawfully be excluded by contract.
Product conformity, purchase, refund and transaction matters are also subject to the Legal & Terms page.
Where this License conflicts with a mandatory rule of applicable law, the mandatory rule prevails and the remainder of this License continues to apply to the extent legally possible.
20. Governing law
This License is governed by Spanish law.
If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the law of your country of habitual residence.
Consumer disputes are subject to the courts or competent bodies determined by mandatory applicable law.
For customers acting exclusively in the course of a business or professional activity, and where legally permitted, the courts of Málaga, Spain, will have jurisdiction.
